In execution of a certain deed of trust dated
February 07, 2003, in the original principal amount
of $106,678.40 recorded in the ClerkÕs Office,
Circuit Court for Rockingham County, Virginia,
in Deed Book 2349 Page 0070, default having
occurred in the payment of the Note thereby
secured and at the request of the holder, the
undersigned Substitute Trustee will offer for sale
at public auction in the front of the Circuit Court
building for Rockingham County, Courthouse
Square, Harrisonburg, Virginia, on June 19,
2013, at 4:45 PM, the property described in said
deed of trust, located at the above address, and
more particularly described as follows:
ALL THAT CERTAIN LOT OR PARCEL
OF LAND WITH ALL IMPROVEMENTS
THEREON, AND ALL RIGHTS, EASEMENTS,
AND APPURTENANCES THEREUNTO
BELONGING, LYING AND BEING SITUATE
IN STONEWALL MAGISTERIAL DISTRICT
OF ROCKINGHAM COUNTY, VIRGINIA, AND
BEING KNOWN AS LOT NO. L 43, ON THE
DECLARATION AND PLAT OF A SUBDIVISION
KNOWN AS SUN VALLEY, SECTION IV, WHICH
IS OF RECORD IN THE CLERKÕS OFFICE OF
ROCKINGHAM COUNTY, AT DEED BOOK 380,
PAGE 162 TO WHICH SAID DECLARATION
AND PLAT, REFERENCE IS HEREBY MADE
FOR THE RESTRICTIONS, STIPULATIONS,
AND CONDITIONS AFFECTING SAID LOT. THE
PROPERTY IS ALSO MORE PARTICULARLY
DESCRIBED IN A PLAT PREPARED BY
RANDALL K. NEWMAN, LAND SURVEYOR,
DATED SEPTEMBER 10, 1996 ENTITLED
ÒTITLE SURVEY OF LOT 43 SECTION 4Ó OF
SUN VALLEY SUBDIVISION A COPY OF WHICH
IS TO BE RECORDED WITH THIS DEED.
TERMS OF SALE: ALL CASH. A bidderÕs
deposit of ten percent (10%) of the sale price
or ten percent (10%) of the original principal
balance of the subject deed of trust, whichever
is lower, in the form of cash or certified funds
payable to the Substitute Trustee must be
present at the time of the sale. The balance of
the purchase price will be due within fifteen (15)
days of sale, otherwise PurchaserÕs deposit may
be forfeited to Trustee. Time is of the essence.
Sale is subject to post sale confirmation that
the borrower did not file for protection under
the U.S. Bankruptcy Code prior to the sale, as
well as to post-sale confirmation and audit of the
status of the loan with the loan servicer including,
but not limited to, determination of whether the
borrower entered into any repayment agreement,
reinstated or paid off the loan prior to the sale.
In any such event, the sale shall be null and
void, and the PurchaserÕs sole remedy, in law or
equity, shall be the return of his deposit without
interest. Additional terms to be announced
