TRUSTEE’S SALE
Residence on Gravels Road
In execution of a deed of trust dated March 30, 2009, and recorded in
the Clerk’s Offi ce of the Circuit Court of Rockingham County, Virginia
(the “Clerk’s Offi ce”) in Deed Book 3490, on Page 794, the undersigned
Trustee will off er for sale at public auction the parcel described below.
Stephen T. Heitz was appointed substitute trustee by instrument
dated March 14, 2014, and recorded in the Clerk’s Offi ce in Deed Book
4388, on Page 351. The public auction will be held at the southern
door of the Rockingham County Courthouse, 80 Court Square, in Harrisonburg,
Virginia on:
Thursday, April 17, 2014, at 12:30 PM

Single family home with three (3) bedrooms and one and one half
(1.5) bathrooms. Brick fi replace in basement family room. Detached
garage.
Terms: The winning bidder must deliver to the Trustee at the time
of sale a bidder’s deposit equal to the lesser of 10% of the sales price
or $10,000.00 by either cash or cashier’s check payable to “Stephen
Heitz, Trustee.” The successful bidder shall pay the balance of the purchase
price within 30 days after the sale date, TIME BEING OF THE
ESSENCE. The Trustee reserves the right to verify that each bidder is
capable of making the bidder’s deposit before the bidding begins. If
purchaser defaults, the deposit shall be forfeited and applied to the
costs and expenses of sale and the Trustee’s compensation as authorized
by the deed of trust and law. Risk of loss or damage to the property
shall be borne by purchaser from the time of the Trustee’s strike
down at the sale.
No representations or warranties of any kind whatsoever are or will be
made as to any matter relating to the property, and the property will
be sold “AS IS”, “WITH ALL FAULTS.” Conveyance shall be with Special
Warranty and shall be subject to all recorded and unrecorded liens,
encumbrances, security interests, easements, rights-of-way, covenants,
conditions, restrictions and leases, to the extent any of the
foregoing may lawfully apply to the property or any part thereof and
take priority over the lien of the deed of trust.
Purchaser shall pay all settlement fees, title examination charges, title
insurance premiums, and recording costs, including the grantor’s recording
tax. Real estate taxes and other public charges will be prorated
from the date of sale. The Trustee will not deliver possession of
all or any part of the property; Purchaser shall have the sole responsibility
of obtaining possession of the property.
The Trustee reserves the right to reject all bids and withdraw the property
from sale, waive the deposit requirements in whole or in part,
and extend the period of time in which the purchaser must make full
settlement. Additional terms of sale may be announced at the sale.
