Pending the outcome of the appeal, the school system has delayed its termination decision.

A Botetourt County high school teacher convicted Tuesday in Juvenile and Domestic Relations District Court of misdemeanor assault and battery of a student has appealed the case to Circuit Court.

Schools Superintendent Tony Brads said the school board will not take up whether to terminate the employment of teacher Victor Terry, 37, pending the outcome of the appeals process. Instead, Terry will remain on paid administrative leave, which Brads described as a "holding status" rather than a "disciplinary status."
